And Justice For All?

Of the four founding ideals and principals that became America only the way the judicial system was established enabled the United States to become a Republic. Today, there has been a complete evaporation of those ideals and principals that for 200 years the United States integrity was unquestionable.

Our judicial system was set up where the individual is presumed innocent first until they are proven guilty " without a shadow of a doubt" by a jury of their peers. Even with the Miranda Act as a protective measure the individuals are now presumed guilty and now have to prove their innocence. Our judicial system has been compromised by a governmental system that is corrupt in that today's governmental officials are primarily elected based on monetary measures instead of a government of the people and by the people that is predicated in the United States Constitution.

By reversing the basic premise in which the individual is innocent until they are proven guilty has far reaching ramifications. First: We are now a nation that is perceived as a socialistic state rather than a Republic where the individuals rights have deteriorated to the point of almost extinction. Second: The swiftness to judge or close a case for expediency without due process only compounds a judicial system that is overloaded with cases to which our correctional facilities are over crowded with tax payers expense, and a society being victims of what governmental laws that are being passed to not protect but to perpetuate a system of a government that is actually failing the general publics welfare. Third: Instead of being a free and open society as was the intention of the Constitution and our founding fathers the United States actually has become a nation whose laws only serve the lawmakers. Fourth: This reversal destroys lives and lively hoods that communities need. There is needless suffering on both ends from the individuals whose innocence is waived to the judicial system whose lack of empathy toward those persons who now are perceived as perpetrators only destroys public support of a judicial system that has ben corrupted.


Where is the justice here? Society is partly to blame for this reversal of our judicial system. The rest of the blame is spread from cities and towns law enforcement agencies where in their quest for the quick and easy solution of criminal activity only triggers more complexity on our already overburden courts and correctional facilities.

If the United States is to survive as intended the way our Constitution was written the judicial system has to reform and structure itself to where the individual rights of every citizen will endure. This is accomplished by reversing the premise of the police and other law enforcement agencies that the individual is always presumed innocent rather than guilty first. Their guilt must be proven not their innocence. The second amendment can meet today's society and reduce the tragic consequences of the violence that is swamping our courts, The technology that was developed 20 years ago can greatly reduce all gun related violence that involve all semi and automatic weapons. All these types of weapons will have micro-chips installed and a corresponding micro-chip must be worn by the person who purchases that weapon so that only that person whose matching micro-chip will be able to use that weapon. DNA testing should be mandatory. Legalizing the use and sale of marijuana and establishing a tax on it will also reduce the over crowding of our courts and correctional facilities while bringing additional revenue to shore up budgets all across the country.

These initiatives will revive a legal system that has so far become a disaster. A fair non partial and adequate judicial system will result because of these actions.
