Cogdill’s Community College Bill Moves Forward

Bill will help recover cost of replacing broken or lost instructional materials

(Sacramento) Legislation to help community colleges recoup the cost of broken or lost classroom items, such as beakers and test tubes, is headed for a vote on the Senate Floor this week. The vote could come as early as today. Assembly Bill 1070, authored by Assemblyman Dave Cogdill (R-Modesto), would permit a community college to charge a student for the replacement cost of broken, damaged, or lost instructional equipment.

Community colleges are really being squeezed right now,” said Cogdill. “As costs for lab equipment and other materials continue to rise, it is important for community colleges to have at least the option of recovering the replacement cost for basic instructional equipment.”

Currently, community colleges are not authorized by law to charge students for broken or lost materials, although many of them had been doing so. A legal review by the Community College Chancellor’s Office determined that legislation was needed in order to authorize such material replacement programs.


To protect students, AB 1070 provides that the fee charged must not exceed the district’s good-faith estimate of the cost to replace or repair the instructional materials. In addition, the fee must be reduced appropriately if budget funding is available to replace or repair the item.

AB 1070 is a responsible measure that protects both students and colleges,” commented Cogdill. “I hope my colleagues in the Senate join me in supporting this important legislation.”
