Environmental & Safety Claims Against REC Silicon Settled

MOSES LAKE, Wash. -- Property owner Victor C. Jansen and RECisEXCEPTIONAL reached a comprehensive settlement with REC Silicon regarding its Moses Lake, Washington expansion. REC Silicon is a division of Renewable Energy Corporation ASA of Norway. A federal lawsuit under the Clean Air Act was one of several claims and counterclaims between the parties that were resolved by the global settlement.

The terms of settlement involved agreement on future actions, the exchange of monetary consideration, the transfer of real estate, and the assignment of rights to the web domain RECisEXCEPTIONAL.com. The web site's stated mission was to "Require Environmental Compliance (REC)" and to promote safety at the Moses Lake facility.

The settlement between the parties included agreement on the text of a prepared statement which reads:


"REC Silicon and Vic Jansen have reached an agreement that resolves all issues of mutual concern and disputes between them. As a result of this agreement, the parties are able to announce the full and complete dismissal of all legal proceedings, and claims by each party against the other.

For REC and Mr. Jansen, the shared focus areas are worker safety, environmental compliance, and the economic vitality of the Moses Lake area and the local community. REC is committed to these matters, and will continue to give them the highest level of attention as it prepares for the expansion of its Moses Lake Plant, with the start-up of Silicon 4.0."
