McPherson Puts Calif. State Voter Guide on Display
20-Day Period for Public Examination of Materials Begins
Secretary of State Bruce McPherson put the contents of all materials that will appear in the state ballot pamphlet/voter information guide including Proposition 80 on public display. Voters can examine and legally challenge the materials by petitioning the Sacramento Superior Court to direct modifications.
The 20-day period allows voters to review the contents of the voter information guide,” Secretary of State McPherson said. “The text of the proposed pamphlet for the November 8 election is posted on our web site and available for viewing in the Secretary of State’s offices throughout the state.”
Elections Code §9092 provides, in part, that a Sacramento Superior court judge could require modifications to the pamphlet’s contents “upon clear and convincing proof that the copy in question is false, misleading, or inconsistent with the requirements” of law and that “issuance of the writ will not substantially interfere with the printing and distribution of the ballot pamphlet as required by law.”
The public display period ends on August 15 and printing of the principal pamphlet will begin. Proposition 80, however, will be on public display until August 16 to complete the required 20-day period. Starting on September 29, ballot pamphlets will be mailed to homes of registered voters. Approximately 12 million pamphlets will be printed.
On July 25, the Third District Court of Appeals ordered the Secretary of State to put the ballot label, title and summary of Proposition 77 on public display. Secretary McPherson placed both the text signed by 951,766 voters and the one submitted to the Attorney General on public display.
Until a final decision is made by the court, I want the people to see both versions. It is the only responsible thing to do,” said McPherson.
The ballot label, title and summary, analysis from the Legislative Analyst’s Office, pro and con arguments, rebuttals to those arguments, yes/no explanations, and texts of the eight initiatives currently headed for the November 8 ballot can be viewed on Secretary McPherson’s website at http://www.ss.ca.gov/elections/vig_special05.htm.
