"SWINE"-FLU DECLARED A NATIONAL EMERGENCY
On Saturday [10.24.2009] the President of the United States, Barack Obama, declared "Swine"-Flu a 'National Emergency'.
AN EXECUTIVE ORDER

"Amendment to Executive Order 13295 Relating to Certain
Influenza Viruses and Quarantinable Communicable Diseases
By the authority vested in me as President by the
Constitution and the laws of the United States of
America, including section 361(b) of the Public Health
Service Act (42 U.S.C. 264(b)), it is hereby ordered as
follows:
Section 1. Based upon the recommendation of the
Secretary of Health and Human Services, in consultation
with the Surgeon General, and for the purpose set forth
in section 1 of Executive Order 13295 of April 4, 2003,
section 1 of such order is amended by adding at the end
thereof the following new subsection:
(c) Influenza caused by novel or reemergent influenza
viruses that are causing, or have the potential to
cause, a pandemic.''.
Sec. 2. This order is not intended to, and does not,
create any right or benefit, substantive or procedural,
enforceable at law or in equity by any party against
the United States, its departments, agencies, entities,
officers, employees or agents, or any other person.

NATIONAL EMERGENCY
With respect to a 'National Emergency' one may wish to visit http://www.law.cornell.edu/uscode/html/uscode50/usc_sec_50_00001631----000-.html with respect to Title 50 USC 1631, which states:
"When the President declares a national emergency, no powers or authorities made available by statute for use in the event of an emergency shall be exercised unless and until the President specifies the provisions of law under which he proposes that he, or other officers will act. Such specification may be made either in the declaration of a national emergency, or by one or more contemporaneous or subsequent Executive orders published in the Federal Register and transmitted to the Congress."
CONTINUITY OF GOVERNMENT

"HSPD 20 [Abstract]
This directive establishes a comprehensive national policy on the continuity of Federal Government structures and operations, and also creates the position of a single National Continuity Coordinator responsible for coordinating the development and implementation of Federal continuity policies. This policy establishes 'National Essential Functions,' prescribes continuity requirements for all executive departments and agencies, in order to ensure a comprehensive and integrated national continuity program that will enhance the credibility of our national security posture and enable a more rapid and effective response to and recovery from a national emergency.
"Catastrophic Emergency" means any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions;
"Continuity of Government," or "COG," means a coordinated effort within the Federal Government's executive branch to ensure that National Essential Functions continue to be performed during a Catastrophic Emergency;
"Enduring Constitutional Government," or "ECG," means a cooperative effort among the executive, legislative, and judicial branches of the Federal Government, coordinated by the President, as a matter of comity with respect to the legislative and judicial branches and with proper respect for the constitutional separation of powers among the branches, to preserve the constitutional framework under which the Nation is governed and the capability of all three branches of government to execute constitutional responsibilities and provide for orderly succession, appropriate transition of leadership, and interoperability and support of the National Essential Functions during a catastrophic emergency;"
