If you have a wrongful death or serious personal injury case, insist on the right personal injury trial law attorney specialist. The attorney fee for a specialist is usually no more than for a non-specialist. A specialist can handle complex cases and normally the insurance companies are willing to pay specialists more. This is because they know a specialist can do a better job and is capable of taking the case all the way through trial and appeal if necessary.

(1) Board Certification. In Texas, it is unethical for any attorney to claim to be a specialist in a particular area of law unless he has been officially certified as a specialist by the Texas Board of Legal Specialization. Only 2.2% of Texas attorneys are board certified in personal injury trial law. To find out about a particular lawyer, go to the official website of the Texas Bar Association at www.texasbar.com. You can also get that information at www.tbls.org. At that website you can also learn the process a lawyer must go through to become certified as a specialist by the board. If you talk to a lawyer that claims to be a specialist but has not been board certified, please report that lawyer to the Texas Bar Association.

(2) Experience. Hire a lawyer that has been a specialist in personal injury trial law for at least ten years. Experience is an excellent teacher. This will make it more likely that the lawyer has dealt with your particular type case and has honed his trial and negotiation skills with the knowledge he/she has gained. Note that a lawyer can become board certified after having been licensed for only three years if he/she also meets the other requirements.

(3) Peer Review Ratings. To learn whether the specialist has the approval of other lawyers, look to his official peer review ratings by Martindale-Hubbell. The highest rating is AV. This is the highest rating for legal ability and ethics.

(4) Case Results. Be sure that the specialist you are considering has actual successful case results for the type of case you have. This information may be on his/her website, or you may have to inquire about it from the lawyer. You donīt want to be the first client the specialist has had of your type case.

(5) Client Service. Other than board certification, this may be the most important point in selecting the right specialist. However, it is probably the most difficult to ascertain if you donīt have a personal recommendation by a former client. You want a specialist attorney that will work hard on your case and keep you well informed. This sounds easy, but the most common reason people are unhappy with their lawyer is the lawyer does not keep the client informed.
